Very rude gentleman who repeatedly interrupted me and did not allow me to finish explaining my case. He said he “doesn’t do medical negligence” and instead handles human rights cases, yet insisted my matter was medical negligence — despite it clearly being a Human Rights Act 1998 claim. The case involves both medical negligence elements and safeguarding failures, but it can and should be pursued under human rights law. I have spoken with university law professors and experts at the Law Society, all of whom confirmed this. For reference: Article 3: Freedom from inhuman or degrading treatment — failing to protect a child from abuse or neglect breaches this. Article 8: Right to private and family life — systemic failures causing harm breach this. Relevant precedents: 1. High Court (2015): £17,000 awarded for systemic safeguarding failures under the Human Rights Act. 2. SZR v Blackburn with Darwen BC (2024): Found that failure to act on safeguarding concerns can breach Article 3. AB v Worcestershire County Council & Birmingham City Council (2023) – Article 3 and 8 breaches for failure to protect. This means the solicitor I spoke with not only dismissed me without hearing all the facts, but was incorrect in stating my matter was purely “medical negligence.” The claim is clearly grounded in human rights law. No lawyer should cut off a client mid-sentence, especially when they admit to doing human rights cases but refuse to consider evidence that the case is exactly that. Many historic safeguarding and medical negligence crossover cases are successfully pursued under the Human Rights Act, especially using the “date of knowledge” principle. I will be reporting this interaction to the Law Society. Update after speaking to my friends law professor i will be making a complaint to the Legal Ombudsman and i suggest anyone that receives rudeness and any disrespectful interaction with this individual or company to report as well to Solicitors Regulation Authority (SRA). The world has too many rude and bad lawyers and there not going to go unless they get reported.
